Iniziata una vertenza legale in più Stati USA per tumore al cervello

Lo studio legale Peter Angelos (specializzato in vertenze ad es. su danni da  amianto , da sigarette, ...) ha avviato vertenze legali contro più provider telefonici per i danni procurati a cittadini che hanno riportato tumori al cervello.

Loro contestano che essi hanno deliberatamente oscurato informazioni mediche e di sicurezza.

Le richiesta di danni sono milionarie e alcuni consulenti di borsa hanno stimato danni per gli operatori telefonici presenti nella borsa di Londra di almeno 5,5 miliardi di sterline per il calo delle quotazioni, in caso di successo delle vertenze !

Mobile firms face lawsuits

Some of the world's largest mobile phone companies are facing billion-pound lawsuits brought by brain tumour victims. The biggest ever legal assault on the industry will seek to prove that handsets can cause cancer and that firms have deliberately covered up crucial medical information.
If the American action is successful, mobile phone companies will face crippling bills for compensation. As investors digested the news, the four major UK opera-tors - Vodafone, BT Cellnet, Orange and One 2 One - and their parent companies, saw £5.5 billion wiped off their share values.

Vodafone, in particular, was said to be a potential target because it owns 45pc of the firm Verizon Wireless, which is said to be named in nearly all the lawsuits. More than half of Britons now own a mobile phone. Medical evidence on the danger to people's health remains ambiguous, with some studies indicating a connection and others ruling it out.

But claims for compensation - set to be launched in March - will be the most extensive examination yet of allegations that radiation from handsets cause cancer. The lawsuits are being brought by one of America's most successful lawyers, Peter Angelos, who recently helped to win £3billion in damages for smokers who suffer from cancer.

John Pica, an attorney at Mr Angelos's firm, said: 'If these companies knew about the dangers of cell phone radiation, they should be punished and they should be punished dearly - not only for what they did to the public, but for the billions of pounds of profits they made.'

The lawsuits - to be launched initially in California, Kentucky and Maryland - will be filed against handset manufacturers and network providers. Experts believe the cases could prompt copycat claims in Britain and the rest of the world.

Telecoms consultant Nick Croll said: 'As long as mobile phone companies are not holding any vital information back, then they are in the clear. 'But if these suits are successful, it would put them out of business.

'The implications would be horrendous because it would mean that users have been subjecting themselves to cancerous signals for the past ten to 15 years.' In each of the actions, Mr Angelos intends to claim compensation for the pain suffered by brain tumour patients, plus the income they lost as a result of the disease. He is also seeking compensation for the families of mobile phone users who have died from brain tumours.

Mr Angelos's firm has not put a total figure on the value of the compensation claims. The official Stewart Report into the safety of mobile phones in the UK, published earlier this year, concluded there was no evidence of harm to people's health. But it also called for more research.

A Vodafone spokesman said that if any compensation claims were filed directly against the company itself, they would be 'vigorously' opposed.

Incremento delle radiofrequenze in 3 città europee

Uno studio è stato condotto per verificare in Basilea (CH), Ghent e Bruxelles (BE) il livello di radiofrequenze in città : nelle vie centrali e periferia, nei luoghi pubblici e nei bus, metro.

I dati vanno letti , secondo me, nel seguente modo:

in poco più di un anno a Basilea l'elettrosmog all'aperto è aumentato del 57%, a Bruxelles del 38% e a Ghent del 20% .

BACKGROUND: The rapid development and increased use of wireless telecommunication technologies led to a substantial change of radio-frequency electromagnetic field (RF-EMF) exposure in the general population but little is known about temporal trends of RF-EMF in our everyday environment.

OBJECTIVES: The objective of our study is to evaluate temporal trends of RF-EMF exposure levels in different microenvironments of three European cities using a common measurement protocol.

METHODS: We performed measurements in the cities of Basel (Switzerland), Ghent and Brussels (Belgium) during one year, between April 2011 and March 2012. RF-EMF exposure in 11 different frequency bands ranging from FM (Frequency Modulation, 88MHz) to WLAN (Wireless Local Area Network, 2.5GHz) was quantified with portable measurement devices (exposimeters) in various microenvironments: outdoor areas (residential areas, downtown and suburb), public transports (train, bus and tram or metro rides) and indoor places (airport, railway station and shopping centers). Measurements were collected every 4s during 10-50min per environment and measurement day. Linear temporal trends were analyzed by mixed linear regression models.

RESULTS: Highest total RF-EMF exposure levels occurred in public transports (all public transports combined) with arithmetic mean values of 0.84V/m in Brussels, 0.72V/m in Ghent, and 0.59V/m in Basel. In all outdoor areas combined, mean exposure levels were 0.41V/m in Brussels, 0.31V/m in Ghent and 0.26V/m in Basel. Within one year, total RF-EMF exposure levels in all outdoor areas in combination increased by 57.1% (p<0.001) in Basel by 20.1% in Ghent (p=0.053) and by 38.2% (p=0.012) in Brussels. Exposure increase was most consistently observed in outdoor areas due to emissions from mobile phone base stations. In public transports RF-EMF levels tended also to increase but mostly without statistical significance.

DISCUSSION: An increase of RF-EMF exposure levels has been observed between April 2011 and March 2012 in various microenvironments of three European cities. Nevertheless, exposure levels were still far below regulatory limits of each country. A continuous monitoring is needed to identify high exposure areas and to anticipate critical development of RF-EMF exposure at public places.

• Temporal trends of RF-EMF exposure in various outdoor and indoor microenvironments were investigated over one year.
• Within one year mobile phone base station exposure levels increased in several Swiss and Belgian microenvironments.
• In contrast to our hypothesis, mobile phone handset exposure did not increase in public transports.
• RF-EMF exposure levels still remained substantially below the ICNIRP guidelines.
Overall, our study gives strong indications that, especially mobile phone base station exposure at outdoor areas increased over the study period between April 2011 and March 2012. At outdoor areas temporal increase was higher in Basel׳s area compared to that in Belgium. This may be due to the difference in increased coverage and capacity demands. A further explanation might be that the introduction of precautionary limits in Belgium, which came in effect in 2009 in Brussels (Ordinance of the Brussels Capital Region of 14 March 2007) and in 2011 in Ghent (Ordinance of the Flemish Region of Nov. 2010) and thus was still in the adaption process during the measurement period, could have slowed down the exposure increase, whereas precautionary limits in Switzerland were established since 2001 (ONIR, 1999).
Interestingly, highest exposure levels occurred consistently in trains across all cities with distinct contribution from mobile phone handsets. This has several reasons: the inner space of a train can be considered as a Faraday cage, reflecting emitted radiation by mobile phones. In addition, the density of people using their mobile phones is usually higher in trains than in other environments. Nowadays, mobile phones are not only used for messaging and calls anymore but rather also for using a large variety of web-based applications (apps), such as news alerts, e-mails, mobile television and many other apps, increasing the use of mobile phone handsets during train rides resulting in higher uplink exposure levels. Moreover, location updates or handovers are executed when moving around in order to maintain constant connectivity to the mobile phone base station of the respective area when the device is in stand-by mode or during a call, respectively (Urbinello and Röösli, 2013). These aspects are also relevant for the exposure situation in buses, trams and metros but in these environments we have mainly measured outside the commuting rush hours (Table 1) with a lower passenger density compared to trains.
The impact of the communication infrastructure on the exposure situation can be exemplarily highlighted by comparing measurements in trams and metros. Total mobile phone handset exposure was considerably higher in metros vs. trams (0.67 V/m vs. 0.21 and 0.41 in trams in Basel and Ghent), whereas mobile phone base station exposure was lower in metros than in trams (0.16 V/m vs. 0.23 and 0.27 V/m). Metros are running underground and in underground stations micro- and pico-cells are installed. Furthermore, the coverage in metros may be poor, so that the mobile devices have to emit with stronger signals.
We have hypothesized that increase of exposure levels would be most pronounced in public transports, because of the strong increase in internet use with mobile phones after the introduction of smart phones. However, this was not the case. Over all public transports combined, temporal trends did not reach statistical significance in all three cities. Lack of significance is partly explained by the higher data variability from handset exposure, which has resulted in larger confidence intervals. The lower increase on the relative scale is probably the consequence of higher exposure levels in public transports. Thus, the increase on the absolute scale is actually higher for many public transports compared to outdoor areas. For instance the observed (significant) 63.7% increase in geometric mean in the central residential area of Basel corresponds to an increase of 0.16 V/m whereas the (non-significant) 39% increase in trains in Brussels corresponds to 1.01 V/m. A further issue which may appear contradictory is the increase of exposure from mobile phone base stations and a decrease of exposure from mobile phone handsets at the airport since there is an interaction between up- and downlink exposure. However, this interaction is complex and it has been demonstrated that the higher are the exposure levels from the base station, the lower is the output power of mobile phones (Yuanyuan et al., 2014 and Aerts et al., 2013). Further, one has to be aware that RF-EMF exposure decreases rapidly with increasing distance and thus, walking through a waiting hall at the airport will not capture uplink exposure from all emitting mobile devices in the considered area.
It is difficult to predict how RF-EMF exposure will further change over time. Assuming a linear trend of increase in RF-EMF exposure, it might be reasonable to argue that exposure will exceed regulatory limits somewhere in the future. However, along with the increase of new telecommunication devices, technologies became also more efficient in reducing emission characteristics of mobile phones. Our results suggest that the increase in number and amount of mobile phone users has not been compensated with more efficient technologies and the net effect is an increase in exposure levels for most microenvironments. Also the output power of mobile phones is affected by the technology. For example second generation mobile phones (2G, GSM) use a power control, radiating with full intensity during connection establishment and down-regulate as soon as a call has been established (Lönn et al., 2004). Smartphones of the third generation (3G, UMTS) in contrast, have a so-called enhanced adaptive power control which optimizes radiation according to the quality of connectivity to the mobile phone base station, resulting in considerable lower average output power (Gati et al., 2009, Persson et al., 2011 and Wiart et al., 2000), which may also affect overall RF-EMF exposure.
Our study offers for the first time a diligent comparison of temporal trends during a year between countries as it based on a common measurement protocol applied in all cities. We could consistently demonstrate that all exposure levels were far below reference levels proposed by ICNIRP (International Commission on Non-Ionizing Radiation Protection). Exposure levels were of the same order of magnitude in all cities. Consistently in all cities, exposure was highest in public transports (train) and lowest in residential areas (central and non-central residential areas). We found substantial increase of exposure levels for most microenvironments. It is crucial to further monitor the exposure situation in different environments in order to examine if and how exposure changes over time and to anticipate critical areas.

Fantastico! l'agenzia americana 'CDC' fa scomparire gli avvisi di precauzione ...

il 9/6/2014 questa importante agenzia americana le cui valutazioni e grida sono seguite dalle altre agenzie ambientali ed il governo americani, dopo aver riportato nelle Domande e Risposte' di adottare criteri di precauzione, dopo che è stato 'scoperto' questa risposta (allo interno del poderoso sito) e che quindi sono stati emessi comunicati stampa in USA e nel Mondo , ovviamente da parte di ambientalisti e da chi è interessato all'elettrosmog,  ora ... per incanto questa risposta cambia !!!

CDC Retracts its Precautionary Health Warning about Cell Phone Radiation
The Centers for Disease Control and Prevention issued a precautionary health warning about cell phone radiation on June 9, 2014 and retracted the warning ten weeks later.

CDC’s new precautionary warning policy was consistent with the policies of more than a dozen national health and radiation safety agencies in developed nations around the world.

Following our press release, Microwave News published a report about this important new policy development in the U.S. (“CDC Calls for Caution on Cell Phones”; 8/16/2014;

Today, the CDC updated the FAQs and removed the precautionary advice it published ten weeks earlier.

Approximately 100 experts on electromagnetic radiation and health have signed declarations that were submitted to the FCC calling for precaution. Radiofrequenze quali (probabili) cancerogeni! è ora di rivedere la classificazione IARC

Vi consiglio di leggere con molta attenzione una nota di  Dariusz Leszczynski, che è uno degli esperti che nel maggio 2011 furoono chiamati da WHO/IARC per valutare la percolosità delle radiofrequenze (telefoni cellulari).

In questo articolo avanza - anche lui -  la proposta di procedere ad una revisione della letteratura scientifico medica prodotta dal maggio 2011 ad oggi per valutare lo stato delle conoscenze.

Nel 2011 a maggioranza furono classificate come POSSIBILI CANCEROGENI per limitate evidenze della sperimentazione su l'uomo, idem per le prove sugli animali .

Per un 'upgrade' della classificazione, ipotizza tre scenari:

  • le evidenze sull'uomo passano a SUFFICIENTI, e allora non importano altri supporti, e la classificazione diviene '1', cancerogeni
  • le evidenze nelle sperimentazioni su animali passano a SUFFICIENTI , pur rimanendo  limitate le evidenze sull'uomo, la classificazione passa a 2A, ovvero possibile cancerogeno
  • se c'è condivisione delle ipotesi di meccanismo d'azione che quindi genera agenti (biochimici) a loro volta pericolosi per l'uomo, la classificazione diventa 1 o 2A.
Cosa c'è di nuovo dal 2011 ?

Gli studi francesi del progetto CERENAT si aggiungono a quelli Interphone e di Hardell, che erano stati considerati a maggio 2011. Quindi 3 repliche completamente separate danno maggiore forza  ai dati epidemiologici.

In merito ai meccanismi di azione, nel maggio 2011 furono avanzati modelli tra loro congruenti che però non furono vincenti nelle votazioni .   Forse la maggioranza si spaventò all' idea di ammettere una ragionevolezza, che avrebbe comportato la classificazione 2A.

Secondo Dariusz i tempi sono maturi per una revisione della classificazione IARC

Una delle principali agenzie americane per la prevenzione delle malettie, suggerisce una riduzione delle radiofrequenze

U.S. Centers for Disease Control and Prevention (CDC) , ha aggiornato il proprio sito, raccomandando cautela con l'uso del telefono cellulare.
Fornisce istruzioni su come ridurre le radiofrequenze vicino al corpo.

Queste indicazioni debbono essere prese in considerazioni da altre agenzie ed enti federali US, tra cui il Federal Communications Commission che dal 1996 ha fissato i limiti di esposizione.  Viene raccomandato un incremento della ricerca non finanziata dalla industria per fare chiarezza .

CDC now asserts that "Along with many organizations worldwide, we recommend caution in cell phone use." As the lead Federal health action agency, CDC provides tips to the public on how to "reduce radio frequency radiation near your body."

Health authorities at the Federal, state, and local level should follow CDC's lead and disseminate precautionary health warnings to ensure that the public is adequately informed about the potential health risks of cell phone use and has the know-how to reduce exposure to the radiofrequency radiation emitted when carrying or using cell phones.

Moreover, the Federal Communications Commission should review CDC's new position in light of the Commission's obsolete regulatory standard for cell phone radiation that was adopted in 1996 when few adults used cell phones.

CDC's latest recommendations represent a considerable improvement in our Federal government's position regarding cell phone radiation health risks and the need for precaution.

CDC indicates that more research is needed to understand the health risks of exposure to cell phone radiation. However, unfortunately the U.S. has been negligent in supporting research on wireless radiation health effects. A major government research funding initiative could be launched with as little as a nickel-a-month fee on wireless subscriptions. This research initiative should be conducted independent of the wireless industry as we have considerable evidence that the industry has undermined much of the research it has funded in the past.

Attenzione alle auto ibride ! attenzione al campo magnetico allo interno ...

Nonostante che nel 2001 WHO tramite IARC ha sentenziato i campi elettromagnetici ad estreme basse frequenze siano possibili cancerogeni, nella progettazione delle auto ibride, dove chiaramente la propulsione è elettrica e quindi una presenza massiccia di batterie e sistemi di ricarica , non si è tenuto conto del campo magnetico che l'autista subisce.

Si propongono delle linee guida nella progettazione di tali auto, ma sono rigettate  tirando il ballo i soliti valori (alti) dell'ICNIRP.

Hybrid and Electric Automobiles Should Be Re-Designed to Reduce Electromagnetic Radiation Risks (rev.)
Hybrid and electric cars may be cancer-causing as they emit extremely low frequency (ELF) electromagnetic radiation (EMR) or magnetic fields. Recent studies of the levels of EMR emitted by these automobiles have claimed either that they pose a cancer risk for the vehicles’ occupants or they are safe.
Unfortunately, the little research conducted on this issue has been industry-funded by companies with vested interests on one side of the issue or the other which makes it difficult to know which studies are trustworthy.
Meanwhile, numerous peer-reviewed laboratory studies conducted over several decades have found biologic effects from very limited exposures to ELF EMR. These studies suggest that the EMR guidelines established by the self-appointed, International Commission on Non-Ionizing Radiation Protection (ICNIRP) are inadequate to protect our health. Thus, even if EMR measurements do not exceed the ICNIRP guidelines, occupants of hybrid and electric automobiles may be at increased risk for cancer and other health problems.
Given that magnetic fields have been considered «possibly carcinogenic» in humans by the International Agency for Research on Cancer of the World Health Organization since 2001, the precautionary principle dictates that we should design consumer products to minimize consumers’ exposure to ELF EMR. This especially applies to hybrid and electric automobiles as drivers and passengers spend considerable amounts of time in these vehicles and health risks increase with the duration of exposure.
In January of this year, SINTEF, the largest independent research organization in Scandinavia, proposed manufacturing design guidelines that could reduce the magnetic fields in electric vehicles (see below). All automobile manufacturers should follow these guidelines to ensure their customers’ safety.
The public should demand that governments adequately fund high-quality research on the health effects of electromagnetic radiation that is independent of industry to eliminate any potential conflicts of interest. In the U.S., a major national research and education initiative could be funded with as little as a 5 cents a month fee on mobile phone subscribers.

Design guidelines to reduce the magnetic field in electric vehicles

Based on the measurements and on extensive simulation work the project arrived on the following design guidelines to, if necessary, minimize the magnetic field in electric vehicles.
For any DC cable carrying significant amount of current, it should be made in the form of a twisted pair so that the currents in the pair always flow in the opposite directions. This will minimise its EMF emission.
For three-phase AC cables, three wires should be twisted and made as close as possible so as to minimise its EMF emission.
All power cables should be positioned as far away as possible from the passenger seat area, and their layout should not form a loop. If cable distance is less than 200mm away from the passenger seats, some forms of shielding should be adopted.
A thin layer of ferromagnetic shield is recommended as this is cost-effective solution for the reduction of EMF emission as well EMI emission.
Where possible, power cables should be laid such a way that they are separated from the passenger seat area by a steel sheet, e.g., under a steel metallic chassis, or inside a steel trunk.
Where possible, the motor should be installed farther away from the passenger seat area, and its rotation axis should not point to the seat region.
If weight permits, the motor housing should be made of steel, rather than aluminium, as the former has a much better shielding effect.
If the distance of the motor and passenger seat area is less than 500mm, some forms of shielding should be employed. For example, a steel plate could be placed between the motor and the passenger seat region
Motor housing should be electrically well connected to the vehicle metallic chassis to minimise any electrical potential.
Inverter and motor should be mounted as close as possible to each other to minimise the cable length between the two.
Since batteries are distributed, the currents in the batteries and in the interconnectors may become a significant source for EMF emission, they should be place as far away as possible from the passenger seat areas. If the distance between the battery and passenger seat area is less than 200mm, steel shields should be used to separate the batteries and the seating area.
The cables connecting battery cells should not form a loop, and where possible, the interconnectors for the positive polarity should be as close as possible to those of the negative polarity.

“The study, led by SINTEF, an independent research organization headquartered in Trondheim, Norway, measured the electromagnetic radiation—in the lab and during road tests—of seven different electric cars, one hydrogen-powered car, two gasoline-fueled cars and one diesel-fueled car. Results from all conditions showed that the exposure was less than 20 percent of the limit recommended by the International Commission on Non-Ionizing Radiation Protection (ICNIRP).”
“Measurements taken inside the vehicles—using a test dummy with sensors located in the head, chest and feet—showed exposure at less than 2 percent of the non-ionizing radiation limit at head-height. The highest electromagnetic field readings—still less than 20 percent of the limit—were found near the floor of the electric cars, close to the battery. Sensors picked up a burst of radiation that same level, when the cars were started.”

While all electrical devices, from table lamps to copy machines, emit EMF radiation, the fear is that hybrid cars, with their big batteries and powerful electric motors, can subject occupants to unhealthy doses. The problem is that there is no established threshold standard that says what an unhealthy dose might be, and no concrete, scientific proof that the sort of EMF produced by electric motors harms people
“We found the highest EMF levels in the Chevrolet Cobalt, a conventional non-hybrid small sedan.”
[The peak EMF readings at the driver’s feet ranged from 0.5 mG (milligauss) in the 2008 Toyota Highlander to 30 mG in the Chevrolet Cobalt. The hybrids tested at 2-4 mG. Here are some highlights from the tests. EMF readings were highest in the driver’s foot well and second-highest at the waist, much lower higher up, where human organs might be more susceptible to EMF.
“To get a sense of scale, though, note that users of personal computers are subject to EMF exposure in the range of 2 to 20 mG, electric blankets 5 to 30 mG, and a hair dryer 10 to 70 mG, according to an Australian government compilation. In this country, several states limit EMF emissions from power lines to 200 mG. However, there are no U.S. standards specifically governing EMF in cars.”

Israel Preps World’s First Hybrid Car Radiation Scale

“The Australian Radiation Protection and Nuclear Safety Agency (ARPANSA) recommends a limit of 1,000 mG (milligauss) for a 24 hour exposure period. While other guidelines pose similar limits, the International Agency for Research on Cancer (IARC) deemed extended exposure to electromagnetic fields stronger than 2 mG to be a “possible cause” for cancer. Israel’s Ministry of Health recommends a maximum of 4 mG.”
“Last year, Israeli automotive website Walla! Cars conducted a series of tests on the previous generation Toyota Prius, Honda Insight and Honda Civic Hybrid, and recorded radiation figures of up to 100 mG during acceleration. Measurements also peaked when the batteries were either full (and in use) or empty (and being charged from the engine), while normal driving at constant speeds yielded 14 to 30 mG on the Prius, depending on the area of the cabin.
The Ministry of Environmental Protection is expected to publish the results of the study this week. The study will group hybrids sold in Israel into three different radiation groups, reports Israel’s Calcalist. It’s expected that the current-gen Prius will be deemed ‘safe’, while the Honda Insight and Civic Hybrid (as well as the prev-gen Prius) will be listed as emitting ‘excessive’ radiation.”

“... concern is not without merit; agencies including the National Institutes of Health and the National Cancer Institute acknowledge the potential hazards of long-term exposure to a strong electromagnetic field, or E.M.F., and have done studies on the association of cancer risks with living near high-voltage utility lines.
While Americans live with E.M.F.’s all around — produced by everything from cellphones to electric blankets — there is no broad agreement over what level of exposure constitutes a health hazard, and there is no federal standard that sets allowable exposure levels. Government safety tests do not measure the strength of the fields in vehicles — though Honda and Toyota, the dominant hybrid makers, say their internal checks assure that their cars pose no added risk to occupants.”
“A spokesman for Honda, Chris Martin, points to the lack of a federally mandated standard for E.M.F.’s in cars. Despite this, he said, Honda takes the matter seriously. “All our tests had results that were well below the commission’s standard,” Mr. Martin said, referring to the European guidelines. Karner, president of Electric Transportation Applications in Phoenix, who tested E.M.F. levels in battery-electric cars for the Energy Department in the 1990s, said it was hard to evaluate readings without knowing how the testing was done. He also said it was a problem to determine a danger level for low-frequency radiation, in part because dosage is determined not only by proximity to the source, but by duration of exposure. “We’re exposed to radio waves from the time we’re born, but there’s a general belief that there’s so little energy in them that they’re not dangerous,” he said.”

Dopo  anni ed anni di incubazione, di ammissioni e rifiuti dalle varie giurisdizioni nei vari stati americani, è stato ammessa una forma di aggregazione di molte delle 39 cause separate di tumori al cervello causati dallo uso di telefono cellulare  (alcuni dei denuncianti nel frattempo ... sono morti).

Pochi giorni fa la Corte Suprema dello Stato di Washington ha ammesso la testimonianza di diversi 'ricercatori indipendenti' sotto evidenziati.

Ora comincia il bello: le due parti debbono presentare alla Corte documenti e prove per rispondere a domande specifiche: è la prima volta che l'industria è chiamata a dimostrare che le radiazioni NON fanno male !!!

Twenty-nine high-profile lawsuits brought by people whose brain tumors
were caused by their cell phones are finally moving toward trial. Six of
these cases were originally filed in 2001 and 2002. Many of the
plaintiffs are no longer alive.

On Friday, Judge Frederick H. Weisberg, in the D.C. Superior Court,
admitted the testimony of five expert witness for the plaintiffs, and
the 12- and 13-year-old cases will now move into the discovery phase.
Each of the plaintiffs is asking for more than $100,000,000. There are
46 defendants including Motorola, Nokia, AT&T, Bell Atlantic, Cellular
One, Cingular Wireless, SBC Communications, Verizon, Vodafone, the
Telecommunications Industry Association, the IEEE, ANSI, the CTIA, and
the FCC. The plaintiffs are represented by Jeffrey B. Morganroth of
Morganroth & Morganroth, a law firm in Birmingham, Michigan.

For over a decade the industry and the plaintiffs have played tug-of-war
with the oldest cases, sending them back and forth between federal and
state courts, and fighting over whether the plaintiff's claims were
preempted by the Telecommunications Act of 1996.

In 2009 the D.C. Court of Appeals, in Murray v. Motorola (982 A. 2d
764), ruled that the telecommunications companies could not be sued over
brain tumors caused by cell phones manufactured after 1996. But since
all of these plaintiffs had used pre-1996 phones, their lawsuits were
allowed to go forward. They were also allowed to go forward on their
claims that the defendants made false and misleading statements and
failed to disclose information about the dangers of cell phones.  These
claims were brought under the D.C. Consumer Protection Procedures Act.

In December 2013 and January 2014, testimony was heard from:

DR. SHIRA KRAMER, a Maryland epidemiologist;

DR. MICHAEL KUNDI, professor of epidemiology and occupational health at
the Medical University of Vienna;

DR. VINI KHURANA, a neurosurgeon and professor of neurosurgery at the
Australian National University in Canberra;

DR. IGOR BELYAEV, head research scientist at the Cancer Research
institute at the Slovak Academy of Science in Bratislava, Slovakia;

DR. WILHELM MOSGOELLER, professor and medical doctor at the University
of Vienna Medical School’s Institute for Cancer Research;

DR. DIMITRIS PANAGAPOULOUS, founder of the Radiation Biophysics
Laboratory at the University of Athens;

DR. ABRAHAM LIBOFF, professor emeritus of physics at Oakland University
in Rochester, Michigan; and

DR. LAURA PLUNKETT, pharmacologist and toxicologist in Houston.

On Friday, August 8, 2014, the testimony of Drs. Kramer, Khurana, and
Panagopoulos was disallowed. But the testimony of Drs. Kundi, Belyaev,
Mosgoeller, Liboff, and Plunkett was admitted. They will testify at
trial about "general causation," i.e. that cell phones can cause brain

The lawsuits now move into the discovery phase, in which each side is
compelled to produce documents and answer questions
. This is the first
time that the industry has had to turn over data. There will then be a
fight over the admission of the testimony of witnesses on "specific
causation," i.e. doctors and others who will testify that these specific
cell phones caused these specific tumors.

Friday's decision by Judge Weisberg allowed 13 of the cases, which have
been consolidated in one action, to go forward.  The other 16 cases are
being tried separately, but the parties in those cases agreed to be
bound by Friday's decision.

In allowing the experts to testify, Judge Weisberg wrote:

"Federal law is the supreme law of the land, but there is no
constitutional provision that says federal facts are the supreme facts
of the land. Federal law can preempt state law, but it cannot preempt
scientific fact. The scientific truth, whatever it may be, lies outside
of the FCC’s regulations about what is “safe” or “unsafe.”

La Corte costituzionale Brasiliana impone una riduzione dei limiti di esposizione ai tralicci della alta tensione

Dopo una vertenza legale intentata da comitati di cittadini di SanPaolo contro una società elettrica , alla fine la Corte Costituzionale ha sentenziato di ridurre il limite di esposizione a 1 microTesta.

NB che in Italia c'è 10 microT con 3 microT per I nuovi impianti.

E stiamo parlando di una delle maggiori potenze economiche mondiali del grippo del BRICS, quindi ossessionate dal mito dell'incremento che PIL, anno per anno e quindi della necessità di avere le risorse sempre a minor prezzo, come la energia elettrica !

The Brazilian Judiciary determined to reduce the level of electromagnetic pollution generated by

power lines to standard adopted by Swiss law (1.0 microtesla).

Two associations of residents in Sao Paulo — the largest city of Brazil — proposed the action.

The plaintiff has pleaded to not be exposed to electromagnetic fields incompatible with the human


The electromagnetic fields generated by power lines that cross these areas is 10 times greater than

the level determined by the court. The judgment of the Court of State of Sao Paulo (Tribunal de

Justica de Sao Paulo) has determined that the concessionaire of electric power reduces the

electromagnetic field generated by power lines that pass through these neighborhoods.

The decision applied the provisions of the Brazilian Federal Constitution — which declare the

protection of health and the balanced environment — and the precautionary principle contained in

the United Nations Conference on Environment and Development (1992), also known as the Rio

Summit, which intended to protect the population against damage to health and the environment.

Judge Renato Nalini, who has several matters published on the protection to the environment,

pronounced the majority opinion. It recognized "the great possibility of the electromagnetic field

of low frequency to be carcinogenic agent in human beings".

The opinion, which widely examined the international research and the pioneering book on the

subject in Brazil, written by Elza Boiteux, Professor of University of Sao Paulo (Universidade de

Sao Paulo — USP) and Fernando Boiteux, concluded: "obligation of the concessionaire of electric

power in reducing the electromagnetic field of the power line to 1.0 μT (one microtesla)." Martin

Blank has participated at the public hearing to explain the risk of electromagnetic fields to human

health based on his research about this subject for over thirty years. His last published book about

is Overpowered (2014).

This judgment puts the Brazilian Judiciary at the same level of others international courts in

defense of the environment and shows the relevance of the research on the risks of

electromagnetic fields.

The concessionaire of electric power filed an appeal to the Brazilian Constitutional Court

(Supremo Tribunal Federal). The Justice Rapporteur designated a public hearing (took place on

March 6th, 7th and 8th, 2013) to consult experts on non-ionizing radiation, public health,

consumers and other interested sectors of the society.

The Brazilian Supreme Court has not decided to take the case yet.

Ancora sul Principio di Precauzione

Una bella tabella che spiega che significa: Principio di Precauzione.

Esso ci aiuta a scegliere se un azione deve o non deve essere fatta, con conoscendo I rischi con certezza.

Le due colonne di destra indicano le possibilità di scelta :  prendere o non prendere quella decisione.
Nella righe sotto sono indicate le previsioni o stime possibili:  possibile grave = NO e possibile grave danno = si.

All'incrocio  delle tabella vediamo che:

- se l'azione non è stata fatta , il beneficio è sempre che  < la vita continua ...>  non importa quale sia la eventuale gravità delle conseguenze, ovviamente.
- se l'azione è stata presa ed non c'è stato un danno grave, < tutto bene! >  ma se invece si è verificato un grave danno: Catastofe! collasso economico ed ambientale con perdite di vite umane !!!

Gli effetti dei campi elettromagnetici artificiali sugli animali

Ho letto con molto interesse l'articolo di un ricercatore spagnolo (Alfonso Balmori) che ha preso in rassegna tutte le pubblicazioni più recenti di ricerche fatte per individuare effetti di EMF su vari animali presenti in  natura.

Raggruppa i lavori scientifici in:

- effetto degli EMF sul comportamento e la navigazione
- effetti sulla loro distribuzione geografica
- effetti sulla riproduzione
- effetti degli stessi su piante.

Le conclusioni tratte sono  che ci sono già molte evidenze scientifiche che suggeriscono una relazione tra campi elettromagnetici artificiali ed effetti dannosi su uccelli , insetti, piante, ed alberi. Queste sperimentazioni  impongono la necessità di studi più mirati ed approfonditi  per capire la loro pericolosità per l'ambiente.

Aggiunge che 'stranamente' nonostante un aumento enorme di , ad es., stazioni radio base ed antenne avvenuto negli ultimi 20 anni, non c'è assolutamente un proporzionale aumento di ricerca in questo campo !  Come mai, dico io ?! [io aggiungo che uno degli effetti del volere che l'industria contribuisca a pagare i costi della ricerca universitaria: gli effetti sono  che 'certe' ricerche siano poco 'appetibili' !]

Interessante è questo  documento molto recente  riportato dal ricercatore  che è una lettera formale del Ministero degli Interni Americano indirizzata al National Telecommunications and Information Administration in cui  richiede che nelle procedure di approvazione e di controllo di torre di comunicazioni (quindi antenne e stazioni radiobase) , oltre a verifiche sul possibile impatto fisico sugli uccelli vengano adottate  valutazioni sugli effetti delle radiofrequenze sugli stessi uccelli !

Brutte notizie : Decreto Competitività arriva in soccorso alle società di telefonia

Riporto un articolo dei nostri perfetti antagonisti nel giornale  il Corriere delle Comunicazioni, in cui  esultano per un qualche articoletto nel Decreto Legge Competitività che riprende  in mano quel famoso articolo del Decreto Crescita che introdusse la deregulation delle misurazioni e quindi 'antenna selvaggia' , che si era arenato per motivi tecnici.

Si dice  " ... Grazie a limiti elettrosmog meno rigidi, infatti, potrebbero riutilizzare le antenne esistenti, senza essere costretti a metterne nuove (come devono fare ora).  ..."

quindi ... vai a tutta birra con le antenne per LTE/4G ...!

Il Ministero dell'Ambiente deve elaborare delle Linee Guida entro 90 gg.

Riusciamo a scrivere al Ministro dell'Ambiente chiedendo che il Principio di Precauzione sia input , oltre che agli articoli del decreto ...?!

Un motivo in più per dire NO agli smart meter : il fuoco !

In Canada , un governo locale (Saskatchewan)  ha ordinato alla società di energia elettrica di rimuovere ben 105.000 smart meter che hanno installato nella provincia, a seguito di diversi incendi causati da queste apparecchiature ...

The recent events in Saskatchewan, Canada have refocused attention on one of the many risks associated with “smart” utility meters, i.e., the increased risk of fires.
As reported this past Thursday, July 31, the Saskatchewan government has ordered SaskPower to remove all 105,000 smart meters that have been installed across the province following several fires linked to the devices.
On Friday, August 1, the news coverage continued in Saskatchewan regarding the smart meter fires. An article in the Leader-Post made reference to a “Smart Meter Fiasco” and gave credit to the provincial government for:
“insisting that eight meters out of 105,000 catching fire (a 99.992-per-cent success rate, according to SaskPower) was simply unacceptable. Setting aside the moral issue of endangering human lives, the liability costs of house fires could be massive. It would have been far more cynical to have just kept installing smart meters in the hope that nothing would happen.”

Class action in Israele arrivata a conclusione

Il tribunale distrettuale di Tel Aviv ha approvato un accordo transattivo a seguito di una class action contro una società telefonica in merito alle emissioni dei loro telefoni cellulari.
Secondo l'accordo la società dovrà dare una comunicazione chiara ed esplicita sulle precauzioni da avere tenendo il telefono non attaccato al corpo.  Inoltre dovranno vendere ad un prezzo minimo concordato gli auricolari, insieme al telefono.  Inoltre la società dovrà garantire il rispetto (SAR) delle caratteristiche di emissioni , dopo riparazione.

The district court in Tel Aviv, approved yesterday (Monday) a
settlement agreement in a class action that was filed against
the cell phone companies Pelephone and Partner, regarding
radiation emission from mobile phones sold by them. A similar
settlement agreement was signed and approved in the past in
front of Mirs (Hot mobile) while the class action in the same
subject against Cellcom, is still being discussed in the court.
In the class action that was filed in 2010 by lawyer Rony
Kordoner, it was claimed among the rest, that Pelephone and
Partner violate their duty to verify after repairing mobile
phones, that they do not emit forbidden radiation, and that
they do not implement the duty to warn customers about risks
in carrying cell phones close to the body. Pelephone and
Partner did not admit the charges, but they agreed to make a
settlement that was already signed in 2013, but was approved
only now.
According to the settlement agreement, within 180 days the
companies will add warning about carrying the mobile phone
close to the body
, in communication documents for the
customers. The warning will include an explanation that part
of the mobile phones manufacturers ask to avoid carrying the
mobile phone at distance of less than 2.5 cm from the body,
and sometimes even less.
In addition, within 180 days Pelephone will start selling for
a limited period of time, wired earpiece at the price of 10
shekels only
, at all her selling points, in order to help
customers avoid exposure to radiation. Partner committed to
sell a tube for the mobile phone, at lower price instead of an
earpiece. But the main part of the settlement is regarding the
commitment of Pelephone and Partner to do radiation
examinations without payment for mobile phones that were sold
by them and were given for repair. The purpose of the
examinations is to compare the radiation level emitted by the
device, vs. the standard. If the mobile phone exceeds the
standard in more than 12%, the customer will be sent to the
manufacturer for repair. Examination of a mobile phone that
has no problem, will be done for payment. After repairing the
mobile phone, or after the customer will be given a renewed
device that went through repair with regard to the
transmission and reception systems of the mobile phone (RF),
the comparison examination will be done without payment. In
other cases, the examination will be done for payment. In the
settlement, Partner and Pelephone will pay 30,000 each to the
plaintiffs, and 200,000 shekels each to the plaintiffs' lawyers.,7340,L-3637149,00.html

2013:  Pelephone, Partner agree to supply cheap earphones to
settle suit

Some mobile phone users will be able to buy cheap earphones
for their devices, following the settlement of a class-action
suit with Pelephone and Partner Communications. The companies
had been sued for alleged radiation risks; the plaintiffs
claimed that providers failed to sufficiently warn them about
the risk of holding their phones to their heads. The
settlement with Pelephone - and a similar one with Partner -
requires the company to provide earphones for all models at
NIS 10 apiece for the next nine months. The offer will be
included in customers’ monthly bills. The company also agreed
to do free checks to ensure that the radiation levels of
devices it repairs are safe. It will now issue clear warnings
regarding radiation risks. ‏
